DIVORCE
Although many people think that with so many marriages ending in divorce the mechanics for obtaining one must always be simple, sadly this is not always the case. The law still requires grounds for divorce and you will often require assistance with choosing the appropriate facts and preparing a divorce petition. If there are children then you will also need to prepare additional documentation relating to their position.

The speed at which a divorce progresses is mostly dictated by the speed of the response from the other party and the Court. Most divorce proceedings are concluded within 6 months, subject only to resolution of finances and any separate proceedings in relation to children. If you are the Petitioner in the proceedings, you may have some or all of your legal costs met by the other party, depending on the facts of your case.

Again, we will not deliberately be confrontational and we see the contents of the divorce petition as a means to an end if both parties believe the marriage has broken down. Allegations relating to the behaviour of one party, for example, will be kept to the minimum necessary to obtain a divorce and often we attempt to agree the content of the petition with the other party before the petition goes to the Court.

Contrary to popular belief, the divorce proceedings themselves can be civilised and amicable.
